terms and conditions
general
You (the client) are expected to read through these Terms of Service (TOS) before requesting a commission.
If the Terms of Service are updated while your commission is currently in progress, your commission and dealings with me (the artist) are subject to the version of the TOS that was in use when your commission was started.
This version of the TOS was updated on: 03 June 2026
I reserve the right to reject any commission inquiry for any reason.
Commissions are NOT first come first served.
You may post work you have commissioned from me on your social media with credit (credit to @siscomknight on Twitter (X), Tumblr, toyhou.se, or my VGen profile).
I may post work created for commissioners on my social media and portfolio unless an agreement has been reached in regards to disclosure. An NDA fee may apply.
My art may never be used in any blockchain related technologies, including NFTs and any form of cryptocurrency.
My art may never be used for training artificial intelligence programs.
I will not work off of references that are AI-generated or created by an artist that heavily utilizes AI.
If the only references you provide are from a doll-maker (picrew, dress-up games, etc) and you want deviations from the reference provided, a partial or full design fee will be added depending on how close the reference is to the desired appearance of your character.
payment and refunds
Payments are made through VGen, PayPal, or Ko-Fi.
Commissions with prices over 100 USD may be split into installment payments, which will be negotiated with the client. The initial payment will be at least 50% of the total price.
When the commission request is accepted, the payment must be sent within 72 hours or the commission request will be rejected and removed from my queue, unless discussed beforehand.
Refunds will only be allowed before you have received an initial sketch.
A partial refund will be available after a sketch has been sent. The amount refunded will be dependent on how much work has been done on the commission.
Partial refunds are not available for colored sketches or chibis.
communication and process
Communication will be done via VGen, Discord, email. Discord is preferred.
Updates will be sent at these stages: (1) sketch for approval, (2) finalized lineart (if applicable), (3) flat colors, (4) fully shaded piece (if applicable), and (5) finalized piece with background and/or graphics (if applicable).
The stages described above may be subject to change, depending on the nature of the request.
Updates will also be sent after revisions have been requested and made at any stage of this process.
Updates will not be made outside of these milestones unless requested.
Major revisions are allowed without any additional charges before the sketch has been finalized.
After the sketch has been finalized, major revisions will incur a fee starting at 5 USD and increasing based on the magnitude of the revision. This fee will never exceed the initial price of the commission.
Minor revisions are allowed without charge throughout the commission process.
No revision requests are allowed for skeb / surprise style commissions.
The only revisions allowed for skeb / surprise style commissions are revisions to fix errors on my (the artist's) part, which includes but is not limited to: missing or incorrect details, incorrect colors.
It is your responsibility as the commissioner to note all important design details in your initial request. If a detail or color is not clearly visible in the reference(s) you initially provided or is not explicitly written out in your initial request, no revision will be allowed.
Commissions will be completed and delivered at most within three (3) months of request, unless I have communicated with you beforehand.
If the commission is not completed within this timeframe, you may request a full refund if there has been no sketch provided, or a partial refund if a sketch has been finalized.
For skeb / surprise style commissions, if the commission is not completed within this timeframe, you may request a full refund if the commission status has not been marked as WIP (work in progress) or a partial refund if the commission status has been marked as WIP.
Your finished commission file will be sent to you via email, Discord, or VGen.
Commissions with a hard deadline within two weeks of the initial request will incur a rush fee.
The amount for the rush fee is subject to change based on (1) the type of commission (2) how close the deadline is.
Some commission requests with hard deadlines may be rejected if I feel I cannot complete the commission type to my standard of quality within the given period of time.
use and intellectual property rights
I retain the rights as the artist and creator of any commissions I create.
My signature may not be removed or edited from any commission.
Commissioned work is for personal use only, unless the appropriate fee has been paid for commerical usage.
If you have previously paid for a commissioned work from me with personal usage rights, you can contact me to discuss the possibility of paying for commercial usage rights for that previous commissioned work.
Personal use includes but is not limited to: avatars/banners on social media (with credit), phone/PC wallpapers, printing for personal usage (ex. on a shirt or as a sticker for yourself).
You may not make profit off of merchandise made using my art unless you have paid for commercial use.
Commercial usage fee for streaming is 1.5x the price of your commission.
Commercial streaming usage includes but is not limited to: any digital assets used for streaming or an online presence in which profit is generated through donations, subscriptions, or similar means of support. Such assets can include but are not limited to emotes, character designs for virtual avatars, reactives / sprites used in videos or on a stream.
Commercial usage fee for merchandising is 2x the price of your commission.
Commercial merchandising usage includes: digital assets and merchandise (avatars, emotes, banners, etc.) to be sold for profit, physical merchandise (prints, stickers, apparel, plushies, charms, etc.) to be sold for profit.
For a non-disclosure agreement (NDA) lasting for a period of less than one (1) month, no additional fee is necessary.
For the duration of the NDA, I will not post your commission or any materials created for your commission to my portfolio or any of my social media accounts, and I will not share your commission with anyone except you, the client.
After the period of time agreed upon has passed, I retain the right to post your commission to my portfolio and social media accounts.
The fee for an NDA is 100 USD for a period of one (1) to four (4) months. An additional fee will be added if the period is longer or needs to be extended.
Paying this fee means I will not post your commission or any materials created for your commission to my portfolio or any of my social media accounts for the period of time agreed upon, and I will not share your commission with anyone except you, the client.
After the period of time agreed upon has passed, I retain the right to post your commission to my portfolio and social media accounts.
The fee for an indefinite NDA is 2x the price of your commission.
Paying this fee means I will not post your commission or any materials created for your commission to my portfolio or any of my social media accounts, and I will not share your commission with anyone except you, the client.
design terms and conditions
I reserve the right to reject service to anyone for any reason.
I retain the rights my designs, artwork, and other intellectual property created by me.
I may post commissioned work and designs created by me on my social media or add them to my portfolio even after transferring ownership unless an agreement has been reached with the commissioner.
When posting or using a design I have created in any way, you must credit me at @siscomknight on Twitter (X), Tumblr, toyhou.se, or my VGen profile.
My signature may not be removed or edited from any commission.
My art and designs may never be used in any blockchain related technologies, including NFTs and any form of cryptocurrency.
My art and designs may never be used for training artificial intelligence programs.

Refunds are not permitted once ownership has been transferred.

If you are paying for a design with art, the art must be completed within a resonable timeframe, as discussed between you and me. If

If you suspect the previous owner of the design has edited or deleted the original design artwork, please contact me so i can provide the original files to you. You must provide reasonable evidence as well as proof of ownership and / or proof of purchase.
Do not delete any designs purchased on toyhou.se from the site.
If a design is purchased by an individual who does not have a toyhou.se account but the design has a listing on the site, the design profile will be kept on my toyhou.se account (@siscomknight) unless traded or resold by the owner to a new owner who has a toyhou.se profile.
Once purchased and ownership is transferred, you may alter my designs in a separate artwork.
My designs may be gifted, traded, or resold. designs may only be resold for at maximum the price they were purchased at + the price of any additional art commissioned by the current owner for the design. my designs may be resold for lower than this price if desired.
The price purchased at is counted as the winning money bid from in the original listing of the design OR the amount the current owner paid when purchasing the design.
If a design was acquired by trading art, characters, or any other type of non-monetary asset, including virtual currencies, it may not be resold for real-world currency unless the current owner has commissioned additional art which has been paid for in real-world currency. In the latter case, the price purchased at is set to $0 and the maximum amount the design can be resold for is equal to the amount of real-world currency the current owner paid to commission art of the design while it was under their ownership.
If a design was gifted to you or was acquired in a free raffle or gacha, the price purchased at is counted as $0, and you may not resell it unless you have commissioned additional art which has been paid for in real-world currency.
My designs are for personal use only, unless the appropriate fee has been paid for commerical usage.
If you have previously paid for a design from me with personal usage rights, you can contact me to discuss the possibility of paying for commercial usage rights for that design.
If you have purchased a design created by me from another individual with personal usage rights, you can contact me to discuss the possibility of paying for commercial usage rights for that design.
You may not use a design created by me as an avatar for streaming (ex. VTubing) or as an online persona or character for use primarily for profit (ex. as a business mascot) if you have not paid the commercial usage fee.
