By commissioning the Creator (siscomknight), the Client agrees to the following terms. This policy governs the relationship between Creator and Client for the specific commission.

The Client is expected to read through these Terms of Service (TOS) before requesting a commission.

If the Terms of Service are updated while the commissioned work is currently in progress, the commission and dealings with the Creator are subject to the version of the TOS that was in use when your commission was started.

The Creator reserves the right to reject any commission inquiry for any reason.

Commissions are NOT first come first served.

The Client may post work that has been commissioned from the Creator on their social media with credit (credit to @siscomknight on Twitter (X), Tumblr, toyhou.se, or my VGen or commissions.gg profile).

The Creator may post work created for commissioners on their social media and portfolio unless an agreement has been reached in regards to disclosure. An NDA fee may apply.

Commissioned work or any of the Creator's works may never be used in any blockchain related technologies, including NFTs and any form of cryptocurrency.

Commissioned work or any of the Creator's works may never be used for training artificial intelligence programs.

The Creator will not work off of references that are AI-generated or created by an artist that heavily utilizes AI.

If the only references provided by the Client are from a doll-maker (picrew, dress-up games, etc) and the Client wants deviations from the reference provided, a partial or full design fee will be added depending on how close the reference is to the desired appearance of the character.

All payments are processed through PayPal, ko-fi, or Stripe via VGen or commissions.gg. If the Client is commissioning the Creator through VGen or commissions.gg, the payment must be processed through the respective platform as per each platform's TOS.

Commissions with prices over 100 USD may be split into installment payments, which will be negotiated with the client. The initial payment will be at least 50% of the total price.

When the commission request is accepted, the payment must be sent within 72 hours or the commission request will be rejected and removed from the Creator's queue, unless discussed beforehand.

Payments are non-refundable, except as described in this section:

Client-Initiated Cancellation. A Client may not unilaterally cancel a paid commission for a refund before the guaranteed delivery date has passed. If the Client requests to cancel the commission before work has been started, a full refund will be issued. If the Creator voluntarily agrees to cancel early, any refund amount is at the Creator's discretion based on work already completed. Partial refunds are not available for select commission services.

Creator-Initiation Cancellation. If the Creator cannot complete the commission, the Creator will issue a refund proportional to the work not yet completed, at the Creator's discretion.

Missed Delivery. If the Creator fails to deliver by the guaranteed delivery date that has been agreed upon by the Creator and the Client, the Client becomes eligible for a refund. Where work is partially complete, the Creator may offer the Client a partial refund proportional to the work not yet completed. The Client may accept the partial refund.

Communication will be done via VGen, commissions.gg, Discord, or email. Discord is preferred.

Updates will be sent at these stages: (1) sketch for approval, (2) finalized lineart (if applicable), (3) flat colors, (4) fully shaded piece (if applicable), and (5) finalized piece with background and/or graphics (if applicable).

The stages described above may be subject to change, depending on the nature of the request.

Updates will also be sent after revisions have been requested and made at any stage of this process.

Updates will not be made outside of these milestones unless requested.

No progress images or updates will be provided for skeb / surprise style commissions.

Major revisions include but are not limited to: composition changes, pose changes, large color changes, any revision that requires significant time and alterations to line and/or form

Minor revisions include but are not limited to: small color changes, small details that that require minimal alterations to line and/or form, mistakes made by the Creator

A revision will be determined to be major or minor at the Creator's discretion.

Major revisions are allowed without any additional charges before the sketch has been finalized.

After the sketch has been finalized, major revisions will incur a fee starting at 5 USD and increasing based on the magnitude of the revision. This fee will never exceed the initial price of the commission.

Minor revisions are allowed without charge throughout the commission process.

No revision requests are allowed for skeb / surprise style commissions.

The only revisions allowed for skeb / surprise style commissions are revisions to fix errors on the Creator's part, which includes but is not limited to: missing or incorrect details, incorrect colors.

It is the Client's responsibility to note all important design details in the initial commission request. If a detail or color is not clearly visible in the reference(s) initially provided or is not explicitly written out in the initial request, no revision will be allowed.

Commissions will be completed and delivered at most within three (3) months of request, unless the Creator has informed and communicated with the Client beforehand.

If the commission is not completed by the guaranteed delivery date that has been agreed upon by the Creator and the Client, the Client may request a full refund if there has been no sketch provided, or a partial refund if a sketch has been finalized, as detailed in the prior section on refunds.

The finished commission file will be sent via email, Discord, or VGen or commissions.gg. If there are issues with delivery, please contact the Creator through the previously established method of communication so another method of delivery can be arranged.

Commissions with a hard deadline within two weeks of the initial request will incur a rush fee.

The amount for the rush fee is subject to change based on (1) the type of commission (2) how close the deadline is.

Some commission requests with hard deadlines may be rejected if the Creator believes they cannot complete the commission type to their standard of quality within the given period of time.

The Creator retains full copyright and ownership as artist and creator of any commissioned work.

The Creator's signature may not be removed or edited from any commission.

Commissioned work is for personal use only, unless the appropriate fee has been paid for commerical usage.

If the Client has previously paid for a commissioned work from the Creator with personal usage rights, the Client can contact the Creator to discuss the possibility of paying for commercial usage rights for that previous commissioned work.

Personal use includes but is not limited to: avatars/banners on social media (with credit), phone/PC wallpapers, printing for personal usage (ex. on a shirt or as a sticker for yourself).

Profitting off of merchandise made using commisisoned work from the Creator is prohibited unless the commercial merchandising license has been paid for.

Commercial usage fee for monetized content (streaming) is 1.5x the price of the commissioned work.

Monetized usage includes but is not limited to: any digital assets used for streaming or an online presence in which profit is generated through donations, subscriptions, or similar means of support. Such assets can include but are not limited to emotes, character designs for virtual avatars, reactives / sprites used in videos or on a stream, images to be used as or in thumbnails, advertisements, or promotions.

Commercial usage fee for merchandising is 2x the price of the commissioned work.

Commercial merchandising usage includes: digital assets and merchandise (avatars, emotes, banners, etc.) to be sold for profit, physical merchandise (prints, stickers, apparel, plushies, charms, etc.) to be sold for profit.

For a non-disclosure agreement (NDA) lasting for a period of less than one (1) month, no additional fee is necessary.

For the duration of the NDA, the Creator will not post the commissioned work or any materials created for the commission to their portfolio or any of their social media accounts, and the Creator will not share the commission with anyone except the Client.

After the period of time agreed upon has passed, the Creator retains the right to post the commissioned work to their portfolio and social media accounts.

The fee for an NDA is 100 USD for a period of one (1) to four (4) months. An additional fee will be added if the period is longer or needs to be extended.

Paying this fee means the Creator will not post the commissioned work or any materials created for the commission to their portfolio or any of their social media accounts for the period of time agreed upon, and the Creator will not share the commission with anyone except the Client.

After the period of time agreed upon has passed, the Creator retains the right to post the commissioned work to their portfolio and social media accounts.

The fee for an indefinite NDA is 2x the price of the commissioned work.

Paying this fee means the Creator will not post the commissioned work or any materials created for the commission to their portfolio or any of their social media accounts for the period of time agreed upon, and the Creator will not share the commission with anyone except the Client.

Refunds are not permitted once ownership has been transferred.

For custom designs, the Creator's standard commission terms and conditions apply.

If the Client are paying for a design with art, the art must be completed within a resonable timeframe, as discussed between the Client and the Creator.

Do not edit or delete the images of the original design artwork.

If the Client suspects the previous owner of the design has edited or deleted the original design artwork, please contact me so the Creator can provide the original files to you. The Client must provide reasonable evidence as well as proof of ownership and / or proof of purchase.

Do not delete any designs purchased on toyhou.se from the site.

If a design is purchased by an individual who does not have a toyhou.se account but the design has a listing on the site, the design profile will be kept on the Creator's toyhou.se account (@siscomknight) unless traded or resold by the owner to a new owner who has a toyhou.se profile.

Once purchased and ownership is transferred, the Client may alter my designs in a separate artwork.

My designs may be gifted, traded, or resold. designs may only be resold for at maximum the price they were purchased at + the price of any additional art commissioned by the current owner for the design. my designs may be resold for lower than this price if desired.

The price purchased at is counted as the winning money bid from in the original listing of the design OR the amount the current owner paid when purchasing the design.

If a design was acquired by trading art, characters, or any other type of non-monetary asset, including virtual currencies, it may not be resold for real-world currency unless the current owner has commissioned additional art which has been paid for in real-world currency. In the latter case, the price purchased at is set to $0 and the maximum amount the design can be resold for is equal to the amount of real-world currency the current owner paid to commission art of the design while it was under their ownership.

If a design was gifted to you or was acquired in a free raffle or gacha, the price purchased at is counted as $0, and you may not resell it unless you have commissioned additional art which has been paid for in real-world currency.

The Creator's designs are for personal use only, unless the appropriate fee has been paid for commerical usage.

If the Client has previously paid for a design from the Creator with personal usage rights, the Client can contact the Creator to discuss the possibility of paying for commercial usage rights for that design.

If the Client has purchased a design created by the Creator from another individual with personal usage rights, the Client can contact the Creator to discuss the possibility of paying for commercial usage rights for that design.

Personal use includes but is not limited to: avatars/banners on social media (with credit), phone/PC wallpapers, printing for personal usage (ex. on a shirt or as a sticker for yourself).

Profitting off of merchandise made using commisisoned work from the Creator is prohibited unless the commercial merchandising license has been paid for.

The Client may not use a design created by the Creator as an avatar for streaming (ex. VTubing) or as an online persona or character for use primarily for profit (ex. as a business mascot) if the Client has not paid the commercial usage fee.

Commercial usage can be transferred between owners only if the ownership is transferred through resale with real-world currency.

If a design created by the Creator is gifted or traded in exchange for anything except real-world currency, even if the previous owner of the design paid for commercial usage rights, the new owner does not have commercial usage rights for the design.
